Terms of Service

1. Acceptance

By creating an account, signing a waiver, or paying for a NeoFit program, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be 18 years of age or older to enter into this agreement on your own behalf. Customers under 18 may use the service only with a parent or legal guardian who agrees to these terms and signs the required waivers.

3. Your account

• You are responsible for keeping your login credentials and payment-method information accurate.
• You agree to give us truthful information at signup, including any relevant health, injury, or pain history that affects program design.
• You agree not to share your account with another person or attempt to access accounts belonging to others.

4. Programs and physical training

NeoFit Performance Institute provides sports-performance training, post-rehabilitation conditioning, recovery services, and executive fitness. We are not a medical or clinical care provider. Nothing on our website or in our programs is medical advice, diagnosis, or treatment.

Physical training carries inherent risks of injury. You acknowledge those risks in the liability waiver you sign at checkout. You agree to follow your coach's guidance, stop any activity that hurts, and seek medical care when appropriate.

5. Payment, billing, and renewal

• Memberships are billed in advance on the cadence shown at checkout (monthly, quarterly, or annual depending on the program).
• Your payment method is charged automatically on each renewal until you cancel.
• Pricing displayed at checkout is the price you pay for the current billing period. We will give you notice of any price change before the next renewal.
• You authorize us, through Stripe, to charge the payment method on file for all amounts due under your selected program.

6. Cancellation and refunds

• You may cancel a recurring membership at any time from the billing portal at /portal/billing or by emailing billing@neofitperformance.com.
• Cancellation takes effect at the end of the current billing period; you retain access until that date.
• The signed payment agreement controls program-specific commitment, refund, rollover, and cancellation terms. If those terms conflict with these Terms of Service for your specific program, the signed payment agreement governs.

7. Acceptable use

• Treat coaches, staff, and other members with respect at all times.
• Do not record or photograph staff or other members without consent.
• Do not attempt to interfere with, reverse-engineer, or probe the security of our systems.
• We may suspend or terminate your access for conduct that endangers staff, members, or the facility.

8. Intellectual property

The NeoFit name, logos, program materials, and website content are our property or licensed to us. You may not copy, modify, or distribute them without written permission, except for personal, non-commercial use of your own program materials.

9. Disclaimers

The service is provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that training will produce any specific result; outcomes depend on individual effort, consistency, and physiology.

10. Limitation of liability

To the fullest extent permitted by law, NeoFit Performance Institute and its officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. Our total liability for any claim arising out of these terms will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim. This limitation does not apply where prohibited by law, including in cases of gross negligence or willful misconduct.

The signed liability waiver you provide at checkout governs claims arising from physical injury during training.

11. Governing law and disputes

These terms are governed by the laws of the State of Mississippi, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the service will be resolved in the state or federal courts located in Harrison County, Mississippi, and you consent to the personal jurisdiction of those courts.

12. Changes to these terms

We may update these terms from time to time. If we make material changes, we will update the effective date and notify active customers by email at least seven days before the change takes effect. Your continued use of the service after the effective date constitutes acceptance of the updated terms.
